Davis of Hinshaw & Culbertson LLP will present on "Cyber Responsibility - Professional Responsibility and Risk Management in The Digital and Social Media Universe."  Technology empowers – but also enormously enlarges the risks facing lawyers and law firms.  It’s getting worse, not better – more, not less complex.  Lawyers’ responsibilities and duties to manage the technology on which they and clients rely are becoming increasingly onerous.  All the while, the threats to data security grow exponentially, exacerbated by the many forms of social engineering.  At the same time, the risks within the technology which lawyers use to communicate with clients continue to expand, and these problems are significantly enlarged when client data is moved across international borders, and are further compounded by increasingly intrusive rules governing data privacy.  In their spare time, individual lawyers create and post on blog and social network sites which are often viewed more than all their firms’ marketing materials.  LinkedIn, Twitter and even Facebook are powerful tools, but come with attendant professional responsibility obligations.  Using social media (and other Internet search engines) as research tools to investigate adversaries, witnesses and jurors carry significant ethical and legal dangers. 

Session Objectives:

1. Understand a lawyer's Duty of Technological Competence.
2. Examine the use of technology in the service of clients and the use of social media in the practice of law.
3. Identify issues and offer suggestions for addressing the ethics and risk management challenges that arise from social networking, and inappropriate digital communications.

Anthony Davis is best described as a lawyer's lawyer. Mr. Davis is a member of the Lawyers for the Profession® practice group and his practice focuses on the laws that govern lawyers. He advises attorneys and law firms on legal professional and ethics issues, law firm creation, merger and dissolution, risk management and loss control.  He is a partner in the Lawyers for the Profession® practice group at Hinshaw & Culbertson and advises attorneys and law firms on legal professional and ethics issues, law firm creation, merger and dissolution, risk management and loss control.

Mr. Davis is a Lecturer-in-Law at the Columbia University School of Law, teaching "Professional Responsibility Issues in Business Practice." As an Adjunct Professor of Law, Mr. Davis taught "Legal Profession" at Brooklyn Law School for many years. Mr. Davis has served as a member of the New York City Bar Professional Ethics Committee and is a former Chair of the Professional Development Committee.

Mr. Davis is the co-author of "Risk Management: Survival Tools for Law Firms, 3rd Edition," and of "The Essential Formbook: Comprehensive Practice Management Tools for Lawyers," both published by the American Bar Association.  In addition to his books, he has written and lectured widely on a variety of legal profession and ethics issues, including a regular bi-monthly column on professional responsibility in the New York Law Journal.
